The state has filed an appeal against a High Court verdict that directed the establishment of an independent and separate secretariat for the Supreme Court.

Attorney General Md Ruhul Quddus Kazal confirmed the development on Thursday (21 May).

On 7 April, the High Court released its full 185-page judgment ordering the government to establish a separate Supreme Court secretariat within three months. The court also restored the Supreme Court’s authority over the control and discipline of subordinate court judges.

The verdict was delivered by a High Court bench comprising Justice Ahmed Sohel and Justice Debashish Roy Chowdhury, which also directed that the government act in line with proposals submitted by the Supreme Court.

Lawyer Mohammad Shishir Manir, representing the petitioners, said the ruling reinstated the judiciary’s authority over lower court administration instead of the President.

The High Court declared unconstitutional the amendments to Article 116 of the Constitution regarding control and discipline of subordinate courts, reviving the original 1972 constitutional provision. It also declared the 2017 Judicial Service (Discipline) Rules inconsistent with the Constitution.

The writ challenging Article 116 and the rules was filed on 25 August 2024 by seven Supreme Court lawyers seeking judicial independence.
