A Dhaka court has issued warrants against Lakeshore Hotel Managing Director Kazi Tareq Shams and his associate MA Masud in a case filed over allegations of breach of trust and fraud.
Dhaka’s Court-4 Additional Chief Metropolitan Magistrate Awlad Hossain Mohammad Junaid passed the order on Monday.
According to the case statement, Kazi Tareq Shams, allegedly with the assistance of MA Masud, fraudulently transferred the shares of Lakeshore Hotel to their own names by taking advantage of the vulnerable condition of his father, Kazi Shamsul Haque, who was suffering from age-related illness and memory impairment.
The victim’s siblings later filed the case with the court, alleging that they had been deprived of their rightful control over his business through the alleged fraud.
Barrister Al Mamun Russell, counsel for the complainants, said the accused allegedly acted in collusion to take control of all the shares by exploiting their father’s illness and deprive other heirs of their rights.
He said the Criminal Investigation Department (CID) investigated the allegations twice and submitted reports to the court, finding prima facie evidence of the alleged fraud.
“After reviewing the investigation reports and relevant documents, the court took cognisance of the case and issued summons against the accused. As they did not appear before the court despite the summons, warrants were subsequently issued against them,” the lawyer said.
In its order, the court said an initial assessment of the investigation reports and relevant documents found prima facie evidence of offences under Sections 406 (criminal breach of trust), 420 (cheating) and 109 (abetment) of the Penal Code.
The court accepted the investigation report and took cognisance of the case for trial before issuing the summons.
As the accused allegedly failed to appear before the court despite being summoned, the court subsequently ordered the issuance of warrants against both Kazi Tareq Shams and MA Masud.
